Mortein Smart Plus “Money Back" Promo Offer - General Terms and Conditions:

1. Mortein Smart Plus “Money Back” Promotional Offer (“Money Back Offer” or “Promotion”) is sponsored and launched by Reckitt Benckiser (India) Private Limited (“Reckitt”) in connection with its product Mortein Smart Plus Liquid Vaporiser with Metofluthrin 0.32% Active Ingredient (“Product”).
2. Participants (as defined below) are able to claim a refund of purchase price paid by such Participant while making purchase of the Promotional Product.
3. The Money Back Offer can be availed by Participants by purchasing the following pack sizes (SKUs) between 1^st March 2024 and 31^st August 2024 (“Promotional Product”):
   a. Mortein Single refill pack

   b. Mortein Buy 4 Get 2 refill multi-pack
4. Money Back Offer shall not be valid on purchases of multiple units. To clarify:
   
   a. For example, if a Participant buys two (2) units of 45 ml liquid vaporizer refill containing Metofluthrin 0.32% Active Ingredient (assuming total purchase price of Rs. X+X = Y), then a maximum refund of purchase price paid for one (1) unit of 45 ml liquid vaporizer refill containing Metofluthrin 0.32% Active Ingredient (i.e. Rs. X) shall be refunded to the Participant under the Money Back Offer.
   b. For example, If a Participant buys one (1) unit of 45 ml liquid vaporizer refill of purchase price Rs. X, and one (1) unit of combo pack (containing one unit of 45 ml liquid vaporizer refill and one unit of vaporizer machine) of purchase price Rs. Y, and one (1) unit of twin pack (containing two units 45 ml liquid vaporizer refill) of purchase price Rs. Z, then a refund of purchase price paid for one (1) unit of lowest-priced SKU/item (i.e. X) shall be refunded to the Participant under the Money Back Offer.
5. The Money Back Offer is valid only in India from 00:00:01 AM on 1st March 2024 to 23:59:59 PM on 31^st August 2024 (herein after referred as "Offer Period").
6. The Promotion is open to all residents of India aged 18 or over on the Promotion start date. Participant understands and acknowledges that he/she/they must be over 18 years of age and a resident of India to access and/or participate in the Promotion. By agreeing to these terms and conditions, Participant represents and warrants to Reckitt that: (a) Participant is at least 18 years old; (b) Participant has not previously been suspended or blocked from participating in the Promotion; (c) Participant’s participation in the Promotion is in compliance with any and all applicable laws and regulations; and (d) Participant is a resident of India.
7. The Money Back Offer is valid for end-users/consumers of the Promotional Product only. Wholesalers, re-sellers, retailers etc. of the Product shall not be eligible to participate in the Promotion. End-user/consumers of the Product participating or seeking to participate in the Money Back Offer shall individually be referred to as "Participant" and collectively as "Participants".
8. To be eligible to participate in the Promotion, the Participant must possess a valid invoice as proof of purchase of the Promotional Product.
9. Eligibility requirements for Participants include a valid residential address, contact number and e-mail ID, apart from other details required by Reckitt/Agency to process the refund to the Participant.
10. The eligible Participants can participate by visiting the website www.morteinmoneyback.com (“Promotion Website”) and follow instructions contained therein to avail the offer.
11. Any Participant purchasing Promotional Product who wishes to participate in the Promotion shall visit the Promotion Website, and provide their full Name, Mobile Number, State of Participation and any other details required for verification of the Participant. By accepting these terms and conditions, Participant gives consent to Reckitt to disclose Participant’s personal information provided to Reckitt to a third-party agency to assist in verifying Participant’s identity. The third-party agency may prepare and provide Reckitt with such an assessment and may use Participant’s personal information including the names, residential addresses and dates of birth, financial information etc. for the purposes of preparing such an assessment. Participant undertakes to provide true, accurate, current, and complete information to the Participant’s personal knowledge at the time of participating in the Promotion, and at all other times (as required by Reckitt). Participants are solely responsible for their participation in the Promotion and any other actions in this regard. Reckitt shall not be responsible for participants’ actions or conduct, or content (including unlawful or objectionable content) submitted by Participants.
12. Post entering the details, Participant will have an option to obtain refund via Amazon Wallet / Paytm Wallet / UPI / Bank Transfer only. For Amazon/Paytm/UPI – Participant will have to provide his/her valid Amazon/Paytm/UPI ID for cash-back to get credited to his/her bank account. In case of bank transfer - Participant will have to provide his/her valid Bank transfer for cash-back to get credited to his/her bank account. The Participant will be responsible for their choice of the method of refund. Participant shall receive the refund between 1st April 2024 and 30th September 2024 post the validation of the payment information from participant & subject to validation of the claim submitted by the Participant. Please note that payment will be processed within a period of thirty (30) days from the date of receiving complete information from the Participant or by 1st May, 2024, whichever is later. All payments are being processed by third party agency, and Reckitt shall not be responsible in case of any delays in payment.
13. Each registered mobile number/UPI ID/Wallet Partner registration credentials will be eligible for only one (1) instance of participation in Money Back Offer during the entire Offer Period.
14. If Participant is not a registered customer of either Wallet Partner, but wishes to receive the refund through a Wallet Partner, Participant will be required to register on the Wallet Partner’s website or wallet mobile application to receive their refund.
15. Reckitt/Agency/Wallet Partner reserves the right to restrict/refuse refund for any account with suspicious behavior or invalid details/credentials. Reckitt/Agency/Wallet Partner has the right to ask for identification documents, including but not limited to Government-issued identification, to prove the Participant identity.Reckitt/Agency/Wallet Partner holds the right to refuse transactions deemed fraudulent as per their policies. In the event of any fraud detection, Reckitt/Agency/Wallet Partner reserves the right to modify/change, discontinue, terminate, or withdraw the Money Back Offer at any time during the Offer Period.Participants found using any unfair means will be immediately disqualified. Reckitt’s decision on such disqualification of a Participant will be final and binding.
16. Participants will be solely responsible for providing correct details such as UPI ID, Account Numbers, Online Wallet details, Mobile Numbers, etc., and Reckitt/Agency will not be responsible for any incorrect entries or details on the Promotion Website. No change in details will be entertained once Participant has submitted the required details.Reckitt accepts no responsibility for difficulties experienced in submitting an entry/claim under this Promotion. Reckitt does not accept responsibility for (1) lost, late or undelivered entries or (2) any technical or access issue, failure, malfunction or difficulty that might hinder the ability of a Participant to participate in the Promotion or (3) any event which may cause the Promotion to be disrupted or corrupted.
17. Participation in this Promotion is purely voluntary. By participating in the Promotion, Participant agrees that they have read and understood these terms and conditions, and Participant agrees to be bound by these terms and conditions.
18. Employees of Reckitt and its affiliates, and their families are excluded from participating in the Promotion.
19. The Money Back Offer is subject to all applicable Central, State, and Local Laws and Regulations.
20. The operational part of the Money Back Offer like collecting Participants’ information and disbursement of monies to the Participants, etc. shall be managed by a third party agency to be appointed by Reckitt.
21. Reckitt reserves the right to reject any Participant's entry without the need to notify the participant of the reasons for rejection.
22. Incomplete information provided or failure to provide true and accurate information as stated in these terms and conditions, failure to submit proof of identification and/or original confirmation number for receiving the refund under the Promotion, will automatically disqualify the Participant. Reckitt shall have the absolute and sole discretion to determine whether any Participant should be disqualified by reason of failure to abide by these terms and conditions, bad faith, fraud or any other legitimate reason.
23. Any costs associated with entering the Money Back Offer incurred by any Participant, including but not limited to accessing the Promotion Website, are the responsibility of such Participant. Also, Participant will be liable for regular call and message rates as applicable per the telecom operators in their respective circles.
24. The Promotional Product purchased by Participants is non-transferable and cannot be used in conjunction with any other promotional offer.
25. Reckitt reserves the right to change the terms and conditions of this Money Back Offer, including extending, withdrawing, or discontinuing the same without notice, without assigning any reason, at their sole discretion and without any liability.All decisions of Reckitt in respect of the Money Back Offer will be final and binding.
26. Reckitt/Agency cannot replace any lost, stolen, or defaced or damaged scratch card.
27. If this Money Back Offer is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of Reckitt, including but not limited to technical difficulties, unauthorized intervention or fraud, which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Money Back Offer, Reckitt reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to invalidate any Participant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.
28. Reckitt/Agency is not responsible for any problems or technical malfunction of any telephone or network or lines, servers or providers, computer equipment, software, technical problems or traffic congestion on a mobile network, or any combination thereof, or any other technical failures including any damage to Participant's or any other person's mobile handset or computer or any other device related to, or resulting from, participation in this Money Back Offer or the downloading of any materials related to this Money Back Offer.
29. Any attempt to deliberately damage the Promotion Website or the information on the Promotion Website, to cause malicious damage or interference with the normal functioning of the Promotion Website, or to otherwise undermine the legitimate operation of this Promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, Reckitt reserves the right to seek damages to the fullest extent permitted by law. If Reckitt suffers loss or incurs any costs in connection with any breach of these terms and conditions or any other legal obligation by the Participant, the participant agrees to indemnify Reckitt for those losses, damages, and costs.
30. Participant agrees to indemnify and hold harmless Reckitt and its affiliates, and each of its and their officers, directors, employees, consultants, licensors, agents, and representatives from and against any and all claims, losses, damages or liability that may be asserted against or incurred by any of them at any time, in connection with entry, or participation or inability to participate in the Promotion. This indemnification obligation will survive the expiry or termination the Promotion or of these terms and conditions.
31. In no event shall Reckitt be held liable for any issues relating to the redemption of the Money Back, including but not limited to request for redemption not being honored by the Wallet Partner/Agency.
32. Reckitt holds no legal and financial liability on unclaimed Money Back Offer beyond the Offer Period.Reckitt accept no responsibility, financial or otherwise for the misuse of any invoice or other Participant details and is not liable for any personal loss or injury and cannot be held responsible for any disagreement concerning quality/ availability of featured Money Back Offer.
33. Reckitt shall not be liable, under or in connection with these terms and conditions or for this Promotion, for any indirect, special or consequential costs, expenses, losses or damages even if such cost, expense, loss or damage was reasonably foreseeable or might reasonably have been contemplated by the Participant and Reckitt, and whether arising from breach of contract, tort, negligence, breach of statutory duty or otherwise. In no event shall the maximum liability of Reckitt exceed the actual purchase price of a single unit of the Promotional Product.
34. No claim shall lie for any redemption requests/claims made by Participants after the expiry of the Offer Period.
35. Participants agree that Reckitt and its affiliates may reach out to Participants for marketing and promotional purposes and share Participants’ information with its affiliates, auditors and service providers as per Reckitt privacy policy.Reckitt’s privacy policy is available at https://reckitt.com/privacy-policy/.
36. Participants hereby agree and confirm to these terms and conditions of the Promotion. Participants freely consent and authorise Reckitt/Agency and its affiliates to collect, store, process and transfer all data (including Participants’ sensitive personal information) for user surveys, analysis, offers and Reckitt brand promotion activities (referred as “Purpose”). Participants herein authorize that their personal information (including sensitive personal information) may be transferred and shared with Reckitt, its affiliates, its Agencies, its agents and service providers for the stated Purpose in India and across the globe. The Reckitt Benckiser plc group of companies/Agency shall always process Participants data in accordance with its privacy policy. Participants may freely withdraw their consent at any time at which time the Reckitt Benckiser Plc group of companies/Agency will immediately cease to process and store the abovementioned data.
37. All intellectual property rights including trademark, copy right and designs used in the Promotion are the exclusive property of their respective owners.
38. Participants consent that Reckitt shall have the right to repost all the material submitted in connection with the Offer (whether written, audio, electronic or visual form, or a combination of those) or any photographs, written materials, video and/or film footage and/or audio recording taken of Participants on social and digital media platforms or submitted on morteinmoneyback.com in the course of participation in the Promotion. Further, all rights to the said materials are assigned by the Participants to Reckitt upon submission and become the exclusive property of Reckitt. Reckitt may use the said materials in any medium in any reasonable manner it deems fit. Copyright in any such materials remains the sole property of Reckitt.The restriction in Condition No. 39 shall not apply to the materials discussed in this Condition No. 31. Each Participant further consents to the use of information supplied by the Participant in any media for future promotional, marketing and publicity purposes of Reckitt without any further reference or payment or other compensation to the Participant, by Reckitt.
39. By participating in this Promotion, Participants fully and unconditionally agree to and accept these Terms and Conditions as well as the decisions of Reckitt, which are final and binding in all matters related to the Promotion. Successfully entering the Money Back Offer and obtaining refund is subject to all requirements set forth herein and at morteinmoneyback.com.
40. The courts of competent jurisdiction at New Delhi (India) shall have exclusive jurisdiction to determine any and all disputes arising out of, or in connection with, the Offer. Participation in the Promotion is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including (without limitation) this clause.
41. All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms and Conditions, or the rights and obligations of the Participants and/or Reckitt pursuant to this Offer, shall be governed and construed in accordance with the laws of the Republic of India.
42. In the event of any inconsistency/contradiction between these terms and conditions and any advertising, promotional, publicity and other materials relating to or in connection with this promotion, these terms and conditions shall prevail.
43. This document is an electronic record in terms of the Information Technology Act, 2000 and rules thereunder as applicable and various other statutes. This electronic record is generated by a computer system and does not require any physical or digital signatures.
44. Subject to the clauses below, the courts of competent jurisdiction at New Delhi shall have exclusive jurisdiction to determine any and all disputes arising out of, or in connection with the Promotion (including the construction, validity, interpretation and enforceability of these Terms and Conditions, or the rights and obligations of Reckitt, Agency, and Participants), as well as the exclusive jurisdiction to grant interim or preliminary relief in case of any dispute. All such issues and questions shall be governed and construed in accordance with the laws of India.
